GDPR stands for "General Data Protection Regulation" and is a policy that takes effect on May 25, 2018. The European Parliament passed this policy to establish data privacy laws amongst all member states of the European Union (EU). The law establishes privacy as a fundamental human right, and grants European Union residents rights over the way in which personal data is used or processed.
What is classified as "personal data"?
The GDPR defines personal data as "... any information relating to an identified or identifiable natural person ('data subject'); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, or online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person."
GDPR also states that various types of online identifiers shall be considered personal data. The GDPR states: "... natural persons may be identified with online identifiers which are provided by:
- Devices
- Applications
- Tools
- Protocols, such as IP (Internet Protocol) addresses
- Cookie identifiers (and similar web tracking technologies)
- Radio Frequency Identification (RFID) tags (the Internet of Things)
What impact does this have on me?
Individuals and businesses that provide services to residents of the European Union need to comply with this law. If you collect, store, or transmit personal data, you must comply with GDPR's terms by May 25, 2018. If you are resident of the EU, this law applies to any data hosted or otherwise stored within your Sitelutions accounted.
The Sitelutions Privacy Policy explains our policies on data collectioon and handling. We recommend that you review this policy prior to signing up with Sitelutions or using Sitelutions services.
What are the rights that GDPR provides to EU residents?
Below are the rights of EU residents with respect to Sitelutions (and how you may exercise your rights as an EU resident):
- Right of access: Customers (or customers of customers) may ask us what personal data is being processed (or used), as well as where and why.
- Right to rectification: You or your customer may remove, revise, or correct data retained on you at any time.
- Right to be forgotten: You or your customer may request that we permanently remove your account and data stored within your account at any time.
- Right to restrict processing: If you or your customer believe that there are inaccuracis in personal data stored, you may request that we limit the use of your data.
- Right of portability: You may transfer or move your data to a third-party at any time.
- Right to object: You or your cusotmer may request that we do not provide targeted or personalized marketing content and remove any data associated with marketing activity.
Sitelutions will comply with GDPR and provide the appropriate support to you so that you may comply with GDPR requests from your customers.
How is Sitelutions in compliance with GDPR?
Sitelutions has been in compliaince with GDPR since May 25, 2018. Work was done to update polices, procedures, and systems to ensure compliance.
How do I need to change my behaviors in order to comply with GDPR?
According to GDPR, two parties are accountable for handling personal data, the "controller" and the "processor." The "processor" processes personal data for the "controller" and acts on behalf of the "controller" has instructed. The "controller" may define the way in which personal data is used.
Both you and SItelutions are required and obligated to comply with GDPR. Generally speaking, Sitelutions is considered the "controller" with regard to your personal data that you provide to us. eNom, the registrar that we use to process domain registrations has established their own GDPR compliance policies which shall apply to the publishing of personal information via WHOIS associated with domain registrations through Sitelutions. In certain situations, you may be considered the "controller" if you decide to transfer certain information from your customers, subscribers, or other contacts to your Sitelutions hosting account. You will then need to comply with GDPR with respect to any personal data stored within your Sitelutions account on behalf of your customers, contacts, or subscribers. We recommend that you seek legal counsel to ensure complaince. Our AUP requires that you only obtain information lawfully, and tha it must be processed in the same way. You must do this in order to complay with GDPR.
