The downloading or use of copyrighted material provided by InfoRelay Online Systems, Inc. or a third-party content provider is allowed by Members for personal use. Members may not copy, reproduce, retransmit, distribute, publish, commercially exploit, or otherwise transfer any such copyrighted material in any format, electronic or otherwise. Any material protected by copyright may not be placed on a Member Site or any other site without the express permission of the author or owner of the copyright on that material. InfoRelay Online Systems, Inc. will not condone the following activities on Sitelutions:

  • Making available copyrighted software which has been "cracked" - i.e., the copyright protection has been removed from the software;
  • Making available serial numbers for software which can be used to illegally validate or register software;
  • Making available tools which can be used for no purpose other than for "cracking" software (this does not include tools which have legitimate uses for software developers, system administrators, etc.).

Backup and Data Storage
Your use of Sitelutions is at your sole risk. Sitelutions performs daily data backups, however manual verfication of backup integrity is only performed by Sitelutions staff once every two weeks. Sitelutions generally does not maintain more than two weeks of backup data. Backup service is provided as a courtesy, and is not guaranteed. Sitelutions is not responsible for data and/or files residing on your account. You agree to take full responsibility for for all data hosted within your account, and to maintain all appropriate backups. Backups will not be provided to users for accounts that have been suspended or terminated. With the exception of certain account types that include access to backup data (such as the InfiniPro), Sitelutions reserves the right to charge a fee to restore backup data. The minimum charge for this is $25, and in some cases, additional fees may apply (when Sitelutions is required to retrieve the backup from tape, or when Sitelutions is required to retrieve a backup older than two weeks). For account types that include unlimited storage, Sitelutions only backs up accounts when the total account data is less than 10,000 megabytes (10,000 million bytes, or 10 billion bytes) of data. Unlimited storage accounts that exceed 10,000 megabytes may not be backed up.

Performance Monitoring & Maintenance
Sitelutions monitors the performance of each of its systems through automated monitoring systems and occasional manual audits. Sitelutions also periodically updates server software. Server updates may require certain systems to be disabled briefly (such as e-mail server software, web server software, and control panel software) and server reboots, which may result in site downtime for a brief period of time. You agree that your use of Sitelutions is at your sole risk, and that you will hold Sitelutions harmless from damages caused by downtime and/or outages.

Because Sitelutions performs regular performance monitoring, and monitoring of resource usage, accounts that may be utilizing an inordinate amount of disk space, RAM, or CPU (but are not within violation of this Acceptable Use Policy) may be moved to other servers that have more resources available for such accounts. Sitelutions staff will generally make all possible efforts to notify the appropriate user of the impending account move, however if the user cannot be reached within a reasonable amount of time, or in extreme cases, Sitelutions may move accounts without first contacting the account holder. Account moves may result in brief site downtime or other momentary issues.

Domain Ownership
Unless otherwise noted by Sitelutions (in the case of certain special offers), all domain names (i.e. "") shall be considered property of the registrant/owner contact specified in the public WHOIS information for the given domain name. If the registrant record is missing or invalid, such a domain name will be considered property of the administrative contact. Sitelutions customers that provide third-party services such as consulting, web design, and hosting for domain owners other than themselves recognize that domains listed under a given Sitelutions account remain property of the registrant/administrative contact, hereafter referred to as "Domain Owner," specified in the public WHOIS information. Adding a domain to a Sitelutions account, registering a domain under a Sitelutions account, or transferring a domain to a Sitelutions account shall not cause such domain to become property of the Sitelutions account holder. Ownership of the domain is specified by the registrant or administrative contact as specified by the WHOIS database.

By using Sitelutions, you agree Sitelutions shall maintain the right to transfer or move domains to the Domain Owner should the owner submit a request in writing for such services to be performed. Sitelutions will, in good faith, grant the following services to the Domain Owner:

  • A transfer of domain registration to another registrar.
  • Control over the domain's DNS.
  • Moving the domain to another Sitelutions account so that the user may fully control the domain and all aspects of DNS/hosting associated with this domain.
The Domain Ownership clause shall be upheld regardless of any disputes, liens, non-payment, or other legal disputes between the Domain Owner and Sitelutions customer.
